Legal Notice for Return of Booking Amount Format
A booking amount refund notice is a written demand asking the other party to return a booking, token or advance payment after a cancelled or failed deal, such as a venue, vehicle, holiday, service or purchase. It states the payment, the reason the money is refundable and a deadline, and cites the Contract Act and consumer law.
When to send this notice
Use this notice when you paid a booking amount and the seller did not perform, cancelled, or refused to refund after you lawfully cancelled, or when a forfeiture clause takes far more than the loss suffered. For a flat or plot in a registered project, use the RERA refund notice, and for a rental deposit use the security deposit notice.
Statutory basis
The right to recover a booking amount depends on the contract and on the Indian Contract Act, 1872. If the other party fails to perform, you can recover damages under Section 73. If the contract becomes void or is rescinded, Section 65 requires a party who received an advantage under it to restore it. Where the contract fixes an amount to be forfeited on breach, Section 74 allows only reasonable compensation not exceeding the amount named. The Supreme Court held in Fateh Chand v. Balkishan Dass (1963) that forfeiture of earnest money must be reasonable, and in Kailash Nath Associates v. Delhi Development Authority (2015) that the party claiming compensation must show loss unless it is difficult to prove. In a consumer transaction, refusing to refund the price after goods or services are withdrawn within the period in the bill, or within thirty days if none, is an unfair trade practice under Section 2(47) of the Consumer Protection Act, 2019, and a one-sided penalty or excessive deposit may be an unfair contract under Section 2(46). The consumer commission can order refund with interest, and a complaint must be filed within two years under Section 69.

Frequently asked questions
Is a booking amount refundable if I cancel?
It depends on the contract and who was at fault. If the seller failed to perform or cancelled, you can recover it. If you cancelled, the seller may keep only reasonable compensation for actual loss, not an excessive forfeiture.
What is the difference between a booking amount and earnest money?
Both are advance payments toward a contract. Earnest money is also a guarantee of performance and can be forfeited on breach, but the forfeiture must be reasonable. A booking amount is usually treated as part of the price unless the contract says otherwise.
Can I go to the consumer commission for a booking refund?
Yes, if you bought goods or services for personal use or a covered purpose. The commission can order refund with interest and compensation, and you must file within two years of the cause of action.
